{"id":1378,"date":"2014-07-30T21:18:14","date_gmt":"2014-07-31T02:18:14","guid":{"rendered":"https:\/\/iowappa.com\/?p=1378"},"modified":"2014-07-30T21:18:32","modified_gmt":"2014-07-31T02:18:32","slug":"1378","status":"publish","type":"post","link":"https:\/\/iowappa.com\/?p=1378","title":{"rendered":"Looking Ahead"},"content":{"rendered":"<p><a href=\"https:\/\/iowappa.com\/?attachment_id=111\" rel=\"attachment wp-att-111\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-111\" alt=\"webeagle\" src=\"https:\/\/iowappa.com\/wp-content\/uploads\/2010\/07\/webeagle1-150x150.jpg\" width=\"150\" height=\"150\" srcset=\"https:\/\/iowappa.com\/wp-content\/uploads\/2010\/07\/webeagle1-150x150.jpg 150w, https:\/\/iowappa.com\/wp-content\/uploads\/2010\/07\/webeagle1.jpg 200w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a><\/p>\n<p>We are always on the lookout for issues that may be coming up in the form of a legislative bill.\u00a0 Most people think that the Iowa Legislative Session begins in January and ends when the legislators adjourn for the year, which is known as <i>sine die<\/i> (Latin meaning go home and don\u2019t come back until next year).\u00a0 Actually, the session may have ended, but the process never stops.<\/p>\n<p>Often, we can predict with some accuracy what sort of proposed legislation we will see in the first month or two of the next session just by keeping up with the Iowa courts.\u00a0 For instance, we know that an opinion by the Iowa Supreme Court that will interpret a statute in a way that sends the case back to the district court will have an effect on prosecutors.\u00a0 The County Attorney Association or the Iowa Attorney General will have a bill introduced that amends the language of that particular statute to comply with what they had thought it meant.\u00a0 Is that good?\u00a0 Sometimes.<\/p>\n<p>On July 18, the Iowa Supreme Court handed down <a href=\"http:\/\/www.iowacourts.gov\/About_the_Courts\/Supreme_Court\/Supreme_Court_Opinions\/Recent_Opinions\/20140718\/11-1339.pdf\">State v. Lyle<\/a>, a case that nullifies a mandatory minimum sentence for a person who committed a crime as a juvenile.\u00a0 On Wednesday, the Iowa Court of Appeals handed down five cases that we will be looking at over the next few weeks, along with the Lyle case.<\/p>\n<p>We\u2019ll review each case and report on what we anticipate as we move through July and August.\u00a0 However, the Iowa Supreme Court is cleaning its docket, and some of its more interesting cases will be handed down on Fridays from now through mid-August.\u00a0 Another interesting opinion may be substituted for one of those we have planned.<\/p>\n<p>We\u2019ll be blogging about <a href=\"http:\/\/www.iowacourts.gov\/About_the_Courts\/Court_of_Appeals\/Court_of_Appeals_Opinions\/Recent_Opinions\/20140730\/13-0836.pdf\">State v.
